1. Introduction and Scope

These Terms of Sale ("Terms") govern all purchases of products ("Products") made by you ("you", "your", "Customer") from Checkout Style ("we", "us", "our") through our website located at https://www.checkoutstyle.com (the "Website").

By placing an order on our Website, you agree to be bound by these Terms. Please read them carefully before making a purchase.

Our Products are created and shipped on-demand by our fulfillment partner, Printful. This means Products are produced specifically for you after you place an order. This impacts aspects of ordering, shipping, and returns as detailed below.

These Terms are governed by the laws of Ireland.

2. Placing Orders

Eligibility: To place an order, you must be at least 18 years old and possess a valid payment method acceptable to us.

Order Process: Browse our Website, select the Products you wish to purchase, choose appropriate sizes/colours/variants, and add them to your cart. Proceed to checkout, provide accurate shipping and billing information, and complete the payment process.

Order Confirmation: After you place an order, you will receive an automated email acknowledging receipt of your order details ("Order Confirmation"). This email does not constitute acceptance of your order.

Order Acceptance: Your order is accepted by us, and a contract of sale is formed, only when we dispatch the ordered Product(s) and send you a shipping confirmation email containing tracking information.

Refusal of Order: We reserve the right to refuse or cancel any order at our discretion, including but not limited to cases of suspected fraud, errors in Product descriptions or pricing, unavailability of materials, or if you breach these Terms.

If we cancel your order after payment has been taken, we will issue a full refund.

3. Pricing and Payment

Currency: All prices are displayed in US Dollars ($) unless otherwise specified.

Taxes: Prices displayed include Value Added Tax (VAT) where applicable under Irish law. For international orders, please see Section 5 regarding customs duties and taxes.

Shipping Costs: Prices listed for Products do not include shipping costs. Shipping costs are calculated based on the destination and the items ordered and will be clearly displayed during the checkout process before you confirm your order.

Payment: Full payment is required at the time you place your order. We accept payment methods as indicated on the checkout page.

Payment Security: We utilize secure payment gateways to process transactions. However, we are not liable for any security breaches of third-party payment processors.

Pricing Errors: While we strive for accuracy, errors in pricing may occasionally occur. If we discover an error in the price of a Product you have ordered, we will inform you as soon as possible.

You will have the option of reconfirming your order at the correct price or cancelling it. If we cannot contact you, we will treat the order as cancelled and issue a full refund.

4. Fulfillment, Shipping, and Delivery

Print-on-Demand Fulfillment: Your Products are custom-made for you by our fulfillment partner, Printful, once your order is accepted.

Production Time: Please allow for production time before your order ships. Estimated production times (typically 2-7 business days, but subject to variation) will be communicated, but are not guaranteed.

Shipping: Once produced, Printful ships the Product(s) directly to the shipping address you provided. We offer various shipping options with estimated delivery times displayed at checkout.

Estimated Delivery Times: Total delivery time includes both production time and shipping time. All delivery times provided are estimates only and are not guaranteed. Delays can occur due to factors beyond our control (e.g., carrier delays, customs processing, peak seasons).

Shipping Address: You are responsible for providing a complete and accurate shipping address. We are not responsible for orders lost or delayed due to incorrect or incomplete addresses.

Risk of Loss: The risk of loss or damage to the Products passes to you upon delivery of the Products to the shipping carrier.

Tracking: You will receive a shipping confirmation email with tracking information once your order is dispatched by Printful.

International Shipments & Customs: For orders shipped outside the European Union (EU), you are the importer of record. You are solely responsible for any applicable import duties, taxes, customs fees, and brokerage fees levied by the destination country.

These charges are not included in the Product price or shipping cost and are typically collected by the carrier upon delivery. We have no control over these charges and cannot predict their amount.

Please contact your local customs office for more information before placing your order. Refusal to pay these fees may result in the package being returned or destroyed, and we will not issue refunds in such cases.

5. Returns, Refunds, and Exchanges

Print-on-Demand Policy: Because Products are printed on demand specifically for you, we generally do not accept returns or exchanges due to customer error, such as ordering the wrong size, colour, design, or simply changing your mind ("buyer's remorse").
We strongly advise you to consult the size charts provided on each Product page before placing your order.

Damaged, Defective, or Incorrect Items: We stand by the quality of our Products fulfilled by Printful. If you receive an item that is misprinted, damaged, defective, or significantly different from what you ordered, please contact us within 14 days of receiving the item.

To initiate a claim: Email us at support@commercegurus.com with your order number, a clear description of the issue, and photographic evidence showing the defect or error.

Resolution: Upon verification of the issue with Printful, we will, at our discretion (in coordination with Printful's policies), offer a replacement item shipped to you at no additional cost, or provide a full refund for the affected item. We may ask you to return the defective item, or instruct you to dispose of it.

Lost in Transit: If your order tracking shows it has been delivered but you have not received it, or if it significantly exceeds the estimated delivery timeframe without updates, please contact us at support@commercegurus.com.

We will work with Printful and the shipping carrier to investigate. If the package is confirmed lost in transit, we will arrange for a replacement or issue a refund. Claims for packages lost in transit must generally be filed within a reasonable timeframe (e.g., 30 days from the estimated delivery date), subject to Printful's and the carrier's policies.

How Print-on-Demand Affects Returns (EU Rights):Our print-on-demand model means each item is custom-created just for you. Under Irish and EU consumer protection laws, while you have many rights, the standard 14-day "cooling-off period" (allowing returns for any reason) often doesn't cover goods made to order or personalised items.

Because your Checkout Style product fits this description, please understand that returns based purely on changing your mind are generally not possible. Of course, this is separate from your full rights if an item arrives faulty, damaged, or incorrect, which are detailed in Section 5.

6. Product Information

Descriptions: We strive to ensure that Product descriptions, images, colours, and specifications on the Website are accurate. However, we do not warrant that they are error-free, complete, or current.

Colour Variations: Please note that colours may appear differently on your screen compared to the final printed Product due to screen calibration and printing processes. Minor colour variations are not considered defects.

Mockups: Product images and mockups are digital representations. Slight variations in print placement or scale may occur in the final Product and are inherent to the print-on-demand process.

7. Intellectual Property

All content on the Website, including text, graphics, logos, images, and designs, is the property of Checkout Style or its content suppliers and is protected by intellectual property laws.

You may not use, reproduce, or distribute any content without our express written permission. Designs printed on Products may be licensed or original creations; the purchase of a Product does not grant you any rights to the underlying design itself.

8. Limitation of Liability

To the fullest extent permitted by applicable law:

Our total liability to you for any claim arising out of or relating to these Terms or your purchase of Products shall not exceed the total amount paid by you for the Product(s) giving rise to the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Website or purchase or use of the Products.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Irish law (including statutory consumer rights).

9. Governing Law and Dispute Resolution

Governing Law: These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law principles.

Jurisdiction: You agree to submit to the exclusive jurisdiction of the courts of Ireland to resolve any dispute arising out of these Terms or your purchase.

EU Online Dispute Resolution: If you are a consumer residing in the EU, you may access the European Commission’s Online Dispute Resolution (ODR) platform: http://ec.europa.eu/odr.

10. Changes to Terms of Sale

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Website.

Your continued use of the Website or placement of orders after such changes constitutes your acceptance of the revised Terms. The Terms in effect at the time you place your order will govern that specific transaction.
